TERMS AND CONDITIONS OF USE AND SALE

Article 1: Application of the general terms and conditions of sale
These general terms and conditions of sale (hereinafter referred to as "GTCS") apply to orders placed on the www.accordchampzz.fr website. These terms and conditions can be accessed at any time on this site, so any order placed on the site will be subject to these terms and conditions.
Article 2: Validation of the general sales conditions
Before placing your order, you declare that you have read and accepted these General Terms and Conditions of Sale. Confirmation of your order therefore implies acceptance of these Terms and Conditions.
Article 3: Protection of minors
In accordance with article L. 3342-1 of the French Public Health Code, which stipulates that the sale of alcohol to minors is forbidden, the creation of an account and the placing of orders on ACCORDCHAMPZZ are reserved for adults aged 18 and over.
Article 4: Orders and validation
4.1 The products offered for sale on the ACCORDCHAMPZZ website are all open to adults residing in metropolitan France. Sales may be offered to persons residing in Corsica or abroad, with additional shipping costs or customs duties, depending on the destination.
4.2 Any order validated by the customer, regardless of the number and product concerned, automatically implies acceptance of these General Terms and Conditions of Sale. The applicable terms and conditions are those in force on the day the order is validated.
4.3 Unless proven otherwise, the data recorded by ACCORDCHAMPZZ during the transaction constitutes proof of all transactions.
4.4 In accordance with the law, orders for private customers are limited to 90 liters (equivalent to 120 bottles of 75 cl) for still wines, and 60 liters (equivalent to 80 bottles of 75 cl) for sparkling wines. In the case of a "mixed" wine order, delivery is limited to 90 liters, or the equivalent of 120 bottles of 75 cl.
Article 5: Prices and products
5.1 Prices quoted for special events and promotional sales are valid only during the promotional period indicated by the site, while stocks last.
5.2 Unless otherwise stated, all prices are quoted in euros (€), inclusive of VAT and exclusive of delivery charges. A detailed invoice is sent to you by e-mail after each order. This invoice is expressed in euros (€) and includes VAT.
Article 6: Payment
6.1 The method of payment is bank transfer on the Axepta BNP Paribas platform. The order will be considered valid only after receipt of payment.
6.2 Orders paid for by credit card (Carte Bleue, Visa, MasterCard, Amex), via a secure payment system, are debited at the time of online payment.
6.3 Customer payments are collected via Axepta BNP's online payment terminal
6.4 Online payment security. The site and mobile application are equipped with a secure payment system via the Axepta BNP server. At the time of payment, Internet users are automatically redirected to Axepta BNP. At no time does ACCORDCHAMPZZ have access to the customer's bank details.
6.5 Any dispute with the bank concerning a payment made on the site by a customer who is the owner of the payment card will incur costs for the company. In the event of this dispute being contrary to the present general terms and conditions of sale, the customer accepts that the company will charge him a fixed indemnity of €30 for the handling of this irregular dispute, and authorizes the company to debit his payment card to settle this claim, or to present him with an invoice which he undertakes to pay within 15 days of receipt.
Article 7: Promotional codes for wine and other leisure activities
7.1 It is possible to use promotional codes on all or part of your order, depending on the terms of the coupon (list of products, minimum purchase amount, type of products, etc.). In the event of fraudulent use of the promotional code, ACCORDCHAMPZZ reserves the right to cancel the orders in question.
7.2 To use these promotional codes, you are invited to enter the information about the code in the field on the order validation page, before paying for your order. Any promotional code not entered before placing the order will not be eligible for reimbursement.
7.3 Fraudulent use includes (but is not limited to) :
- the creation of multiple customer accounts, sharing the same delivery address and/or the same contact details or order-taking IP address, in order to benefit from multiple promotions.
- cancellation of a previous order in order to place a similar order with a promotional code.
- repeated manual or computerized data entry, with the aim of guessing non-diffused promotional codes present in the system.
Article 8: Delivery
8.1 Several delivery methods may be offered to the customer depending on the method of receipt of the parcel(s) or the delivery time.
8.2 In the event of an incomplete or erroneous delivery address, obliging our carrier to return the product(s) ordered, any additional costs incurred by this failure or error will be borne in full by the end customer. Likewise, in the event of non-receipt at the relay point within the specified time (7 days), the parcel will be returned to us by the carrier, and any re-delivery will be subject to a charge (€20/carton of 6bt).
8.3 Packages are delivered in accordance with the carrier's terms and conditions of delivery. The carrier is responsible for the goods from the moment they are taken in charge by the carrier. Under no circumstances shall ACCORDCHAMPZZ be held liable for any incident occurring during transport. However, in the event of such an incident, ACCORDCHAMPZZ and/or the seller will ensure that the goods are received by the customer or reimbursed, and will take the necessary steps with the carrier.
8.4 Customers have the right to return delivered products in accordance with article 10 below.
8.5 Delivery times are calculated in working days. Orders are delivered within an average of less than 10 working days.
8.6 In the event that the package is damaged in transit, the customer must notify the carrier upon receipt of the package. The customer is therefore obliged to check the contents of the package in the presence of the carrier, in order to make a reservation in the event of non-conforming contents or damage. Any package accepted without reservation will not be eligible for subsequent claims. The reservation must be descriptive (e.g.: a missing bottle) and may not contain "subject to opening the box". In all cases, the maximum time limit for reporting a damaged parcel is 3 days after delivery, in accordance with article L.133-3 of the French Commercial Code.
Article 9: Calculation of shipping costs
9.1 Shipping costs are invoiced to customers at the rate in effect when the order is placed. Delivery charges may be revised from time to time.
9.2 Shipping costs are calculated according to the delivery method chosen (personal address or parcel relay), the type of product purchased and the country and city of residence.
Article 10: Reservation of ownership
10.1 Until full and effective payment of the price, ACCORDCHAMPZZ remains responsible for organizing the sale of goods on its website. Full payment shall constitute transfer of ownership, however the purchaser shall become responsible for the items as soon as they are delivered, and transfer of possession shall constitute transfer of risk.
10.2 In the event of non-payment of the total price of the goods on the agreed due date, ACCORDCHAMPZZ will cancel the sale of the products at the customer's expense and risk.
Article 11: Customer service, withdrawal and return of goods
Article 11.1: Non-conformity of the products ordered, Error in the content of the order :
11.1.1 Any request for the return of a product based on an "error" must be addressed to the customer service department within a maximum period of 14 clear days from the date of receipt of the product by the customer. When initiating a returns procedure, we invite the customer to provide us with a precise written description, together with a copy of the invoice.
11.1.2 Products that have been the subject of an "error" in the preparation of the order will be replaced by identical products or, in the absence of availability, will be reimbursed.
11.1.3 The cost of returning goods in error will be borne by the seller. It is the responsibility of the customer who returns a product in error to provide proof that he has reshipped the goods. Such proof may be provided either by presentation of a registered post receipt, or by presentation of a document issued by a carrier entrusted with forwarding the returned product. No other method of proof will be accepted.
Article 11.2: Non-conformity of ordered products, defective products :
11.2.1 Any request for exchange based on the "defective" nature of a product must be the subject of a request for return addressed to the customer service department, within a maximum period of 6 clear months from the date of receipt of the product by the customer. When initiating a returns procedure, we invite the customer to provide us with a precise written description of the defect(s) affecting the product received, together with photographs.
11.2.2 Products deemed or identified as defective by the end customer will be replaced by identical products or, in the absence of availability, will be refunded. However, the definitive nature of an exchange and/or refund acceptance is subject to the examination of the defective product by ACCORDCHAMPZZ or by the seller of the product. Thus, if after investigation by our services, it turns out that the product's failure is the result of inappropriate use, mishandling or modification of the product's initial characteristics at the initiative of its final purchaser, then the product will not be exchanged or reimbursed and will not give the right to any compensation. ACCORDCHAMPZZ thus reserves the right to reverse its decision to accept an exchange, credit note or refund if the customer's description of the defect does not correspond to its findings, or if the product failure is attributable to the end user.
The customer has the right to refuse the exchange of a defective product for an identical product. In this case, ACCORDCHAMPZZ will refund an amount equal to the purchase price including shipping costs initially paid at the time of order.
11.2.3 In the event that a defective product cannot be replaced by an identical product or one of equivalent quality and price, ACCORDCHAMPZZ will refund an amount equal to the purchase price including shipping costs initially paid at the time of order.
11.2.4 Defective products following a return procedure must be returned in their original packaging, accompanied by the defective or damaged parts and a legible copy of the invoice. Upon receipt, ACCORDCHAMPZZ may carry out the necessary checks in the event of any doubt as to the conformity of the returned products with the attached invoice and return number.
11.2.5 The cost of returning a defective product will be borne by the seller and will be reimbursed to the customer by the seller upon presentation of the corresponding receipt after receipt and verification. It is the responsibility of the customer returning a defective product to provide proof that the goods have been reshipped by the customer. Such proof may be provided either by presentation of a registered post receipt, or by presentation of a document issued by a carrier entrusted with the carriage of the returned product. No other method of proof will be accepted.
11.2.6 In the event of failure to comply with the present returns procedure and an inconsistency between the request and the working conditions for reimbursement, credit note or product replacement, no action will be taken on this request, and ACCORDCHAMPZZ declines all responsibility in this respect.
Article 11.3 Return of goods :
11.3.1 To return a product, the customer may contact Customer Service. However, Customer Service is not authorized to receive returned products, and only products following a strict returns procedure will be accepted by our services. Customers wishing to initiate a procedure for any reason whatsoever are invited to report their requests to Customer Service.
11.3.2 Customer service will notify the customer by e-mail of the acceptance or refusal of an exchange, and of the possible issue of a credit note or refund. If the principle of an exchange, the issue of a credit note or a refund is confirmed, the customer must return the defective product to the address indicated in our reply message, clearly and distinctly indicating on the parcel the returns number given to him by Customer Service. In the case of a product sold directly, the return address may be different from that of ACCORDCHAMPZZ's head office, and may therefore be returned directly to the producer.
11.3.3 ACCORDCHAMPZZ reserves the right to carry out the necessary checks in the event of any doubt as to the conformity of the returned products with the attached invoice and return number.
11.3.4 The customer is responsible for return shipping costs. It is the responsibility of the customer who returns a product ordered in error to provide proof of the return of the goods. Such proof may be provided either by presentation of a registered post receipt, or by presentation of a document issued by a carrier entrusted with forwarding the returned product. No other method of proof will be accepted.
11.3.5 In the event of failure to comply with the present returns procedure and an inconsistency between the request and the working conditions for reimbursement, credit note or product replacement, no action will be taken on this request, and ACCORDCHAMPZZ declines all responsibility in this respect.
Article 11.4 Right of withdrawal :
11.4.1 In accordance with articles L121-16, L121-19 and L121-20 and article L121-20-1 of the French Consumer Code, products may be returned within 14 working days from the date of delivery of the order. At the end of this period, the right of withdrawal becomes irretrievably null and void. Products must be sent in accordance with the return procedures mentioned in article 11.3. ACCORDCHAMPZZ will then refund the products or, with the customer's agreement, exchange them (art. L121-20-1).
11.4.2 It is the responsibility of the customer exercising his right of withdrawal to provide proof of the return of the goods. Such proof shall be provided either by presentation of a registered post receipt, or by presentation of a document issued by a carrier entrusted with the forwarding of the returned product. No other method of proof will be accepted.
11.4.3 In any event, products must be returned in their original packaging, intact, clean and complete (in resaleable condition, not modified), accompanied by a legible copy of the invoice.
11.4.4 The cost of returning goods for retraction will be borne by the customer, including in the event of refusal of the parcel or failure to collect the goods from a relay point within the specified time. It is the responsibility of the customer who returns a product ordered in error to provide proof of the return of the goods. This proof will be provided either by the presentation of a registered post receipt, or by the presentation of a document issued by a carrier entrusted with the routing of the returned product. No other method of proof will be accepted.
Article 11.5: Refund conditions :
11.5.1 If the return is accepted by ACCORDCHAMPZZ under the conditions and within the time limits set out in these GTC, the returned products will be reimbursed within 14 days at the latest from the time the right is exercised. This reimbursement will not give rise to any payment of interest, unless it is made after the expiry of the 14-day period and provided that the delay is exclusively attributable to ACCORDCHAMPZZ.
11.5.2 This refund will be made in cash and credited to the bank account or transfer from which the payment received by ACCORDCHAMPZZ was issued.

Article 12: Site content and consumer product reviews
12.1 Product and domain presentation content
ACCORDCHAMPZZ cannot be held responsible for the accuracy, veracity or reliability of information provided by producers. The producer is solely responsible for the content of his showcase.
12.2 Consumer opinions on products
ACCORDCHAMPZZ collects product reviews on the platform.
12.2.1 Your identity
Reviews are therefore linked to consumer experiences and sent by consumers identified by an account. This verification can be done by e-mail, SMS or telephone. Our team may need to contact you to verify these points or your identity.
12.2.2 Your commitments
When you submit a review on the platform, you must comply with the following conditions:
- You have had personal experience of consuming the product noted
- You have no conflict of interest in writing it
- You are an individual
- You guarantee that your opinion is genuine
- You agree to use appropriate language, free of foul language, and in accordance with the law.
12.2.3 Moderation
The company is required to check reviews written by users to ensure that they comply with the law and the general conditions of use. Rejection of an article is carried out manually by the moderation team, and may lead to its deletion or deactivation. Moderation takes place within a maximum of 7 days.
The reasons for moderation are as follows: contradictory rating and review, review of a product different from the one described, defamatory review, review related to the purchasing experience and not to the product, review containing personal information about the user intended to be private, advertising for a competing product, review suggesting that the consumer has not consumed the product, conflict of interest, insults, spam, presence of URL, retraction following a call to customer service, content contrary to the law.
12.2.4 Displaying notices
All reviews are displayed, whether positive or negative, as long as they have not been rejected. The date of publication is shown, along with the first name and first letter of the author's surname.
Article 13: Data confidentiality
13.1 At any time, the customer "has the right to access, modify, rectify and delete his/her data" (art. 39 and 40 of the French Data Protection Act of January 6, 1978). To exercise these rights, they should write to the site's head office (see article 10.6).
13.2 Personal data is necessarily collected in order to process the customer's order and is intended for internal use by ACCORDCHAMPZZ. However, it may be transmitted to third parties if the customer has given his prior consent by ticking the appropriate box.

The ACCORDCHAMPZZ website is an intellectual work protected by the laws of Intellectual Property. The site and its components are the exclusive property of EI BRASY NICOLAS. All elements of the site and the application, in particular texts, presentations, illustrations, photographs, tree structures and layouts are, except for public documents and additional details, the exclusive property of EI BRASY NICOLAS. As such, their representation, reproduction, nesting, distribution and redistribution, in whole or in part, are prohibited. Any person doing so without being able to justify prior and express authorization from the holder of these rights incurs the penalties relating to the offence of counterfeiting provided for by the Intellectual Property Code. Article 15: Site accessibility ACCORDCHAMPZZ
As with any website, ACCORDCHAMPZZ must update and maintain its network. ACCORDCHAMPZZ undertakes to carry out its maintenance operations outside working hours and for a limited time.
Article 16: Responsibilities
16.1 All products sold by ACCORDCHAMPZZ are the subject of a very complete online description so that the customer has all the necessary information prior to purchase. Before placing an order, the customer may contact customer service to ask any questions relating to the product.
16.2 In accordance with French common law, ACCORDCHAMPZZ shall be liable to its customers exclusively for any proven fault which causes them damage or injury in the performance of its own contractual obligations. However, ACCORDCHAMPZZ may not be held liable for indirect damages such as those mentioned below, whatever the cause: any economic loss such as loss of earnings, loss of anticipated savings, cancellation or termination costs, loss of image, profits and/or expected profits and/or opportunities. ACCORDCHAMPZZ cannot be held responsible for weak password security, errors, unavailability of information and/or tools, or the presence of viruses on its site.
16.3 In any event, in the event that ACCORDCHAMPZZ is held liable for products delivered by ACCORDCHAMPZZ, the parties agree that the compensation payable by ACCORDCHAMPZZ will be limited to an amount equal to the last invoice issued by ACCORDCHAMPZZ for products delivered or not delivered to the Customer.
Article 17: Applicable law and settlement of disputes
17.1 These GCS, as well as any acts resulting from them, are governed by French law.
17.2 All users of the site are invited to familiarize themselves with the legislation applicable in their country, particularly with regard to any provisions of the present document that may contravene it.
17.3 In the event of a dispute arising from the interpretation or execution of these GTC and GCU, the Parties undertake to seek an amicable solution. If such an amicable solution cannot be found, the dispute shall fall within the exclusive jurisdiction of the French courts.

If the company collects your telephone number when you create an account or place an order, we inform you that your telephone details will only be used to process your orders, or to contact you to offer you services. Registration on this list is free of charge and is compulsory for all professionals, with the exception of those with whom you have already concluded a contract.
Appendix 1
Article L. 217-4 Consumer Code
The seller is obliged to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when the latter was his responsibility under the contract or was carried out under his responsibility.
Article L. 217-5 Consumer Code
The property conforms to the contract:
- Whether it is fit for the purpose ordinarily expected of similar goods and, if so :
- if it corresponds to the description given by the seller and has the qualities presented to the buyer in the form of a sample or model;
- it has the qualities that a purchaser may legitimately expect in the light of public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
- Or if it presents the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter.
Article L217-12 of the French Consumer Code
Any action arising from a lack of conformity must be brought within two years of delivery of the goods.
Article L. 217-16 Code de la Consommation :
When the buyer asks the seller, during the course of the commercial warranty granted at the time of purchase or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period. This period runs from the date of the buyer's request for service or from the date the item in question is made available for repair, if the item is made available after the request for service.
